1. Overview

Welcome to FairFinds. The terms “FairFinds,” “we,” “us,” and “our” refer to the FairFinds marketplace platform and its operators.

FairFinds operates an online marketplace website that connects buyers with independent third-party sellers of golf-related products (the “Services”). FairFinds is powered by Shopify, which provides the technical infrastructure that enables the Services.

FairFinds is not the seller of items listed by third-party sellers and does not own, inspect, manufacture, store, or ship marketplace products.

These Terms of Service (“Terms”), together with any policies referenced herein, govern your access to and use of the Services.

By accessing, browsing, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility and Account Responsibility

You must be at least the age of majority in your jurisdiction and legally capable of entering into binding contracts to use the Services.

If you create an account, you agree to:

• Provide accurate and complete information

• Maintain the security of your login credentials

• Accept responsibility for all activity under your account

Accounts may not be transferred or assigned without our written permission.

3. Marketplace Role and Transactions

FairFinds provides a platform that allows independent sellers to list and sell products directly to buyers.

FairFinds:

• Is not the seller of marketplace items

• Does not verify seller listings

• Does not guarantee product quality, authenticity, safety, or legality

• Does not control fulfillment or shipping

All product descriptions, pricing, images, and representations are provided solely by sellers.

When you place an order, you are entering into a transaction directly with the seller. FairFinds facilitates the marketplace environment and payment processing but is not a party to the sales contract.

4. Orders, Pricing, and Payment

Prices are set by individual sellers unless otherwise stated.

Prices may not include taxes, duties, or shipping unless explicitly indicated.

You agree to provide valid payment information and authorize charges for purchases made through the Services.

All payments are processed through third-party payment processors. FairFinds does not control payment processor decisions, including payment holds, account restrictions, or processing delays.

5. Shipping and Delivery

Shipping and delivery are the responsibility of the seller.

Delivery times are estimates only.

Risk of loss transfers to the buyer when the seller delivers the item to the carrier.

FairFinds is not responsible for:

• shipping delays

• lost packages

• carrier errors

• delivery failures

6. Returns and Refunds

Returns and refunds are governed by the FairFinds Returns & Refund Policy and applicable law.

Sellers are responsible for handling approved returns and issuing refunds where required.

7. Intellectual Property

All content provided by FairFinds — including logos, branding, design, text, and graphics — is owned by FairFinds or its licensors and protected by intellectual property laws.

You may not copy, reproduce, distribute, or use FairFinds content without written permission.

8. Third-Party Services and Shopify

The Services may include third-party tools, integrations, or links.

FairFinds provides such tools “as is” and is not responsible for third-party services.

FairFinds is powered by Shopify, but Shopify is not responsible for marketplace transactions between buyers and sellers.

9. Privacy

Your use of the Services is subject to our Privacy Policy.

Payment processors and platform providers may also collect and process data under their own privacy policies.

10. Prohibited Use

You may not use the Services to:

• violate laws or regulations

• commit fraud or deception

• misrepresent products

• interfere with platform operations

• bypass security systems

• harass or harm others

We may investigate and take action against violations.

11. Platform Enforcement Rights

FairFinds may, at its sole discretion and without notice:

• remove listings or content

• cancel transactions

• restrict account activity

• suspend or terminate access

• investigate behavior

We are not required to provide justification for enforcement actions.

12. Disclaimer of Warranties

THE SERVICES AND ALL MARKETPLACE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

FAIRFINDS DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR RELIABILITY

We do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, FairFinds shall not be liable for:

• seller conduct or products

• buyer-seller disputes

• shipping or fulfillment issues

• platform interruptions

• data loss

• indirect or consequential damages

Our total liability shall not exceed the amount paid to FairFinds in the twelve (12) months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless FairFinds and its affiliates from any claims, damages, losses, or expenses arising from:

• your use of the Services

• your violation of these Terms

• your transactions

• your listings or products

This includes legal fees.

15. Dispute Resolution and Arbitration

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in the State of Florida.

You waive the right to:

• trial by jury

• class actions

• collective proceedings

Claims must be brought individually.

16. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

17. Force Majeure

FairFinds is not liable for delays or failures caused by events beyond reasonable control, including:

• natural disasters

• system outages

• government actions

• war

• infrastructure failures

18. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for violations of these Terms or for any lawful reason.

19. Electronic Acceptance

By using the Services, creating an account, or placing an order, you electronically agree to these Terms. Electronic acceptance is legally binding.

20. Entire Agreement

These Terms, together with referenced policies, constitute the entire agreement between you and FairFinds regarding the Services.

No other statements or communications modify these Terms.

21. Changes to Terms

We may update these Terms at any time. Continued use of the Services after updates constitutes acceptance.
